Service Agreement

Each person ("Client") requesting service by or through 2RepairaComputer.com website owned by WebSoftMaster ("2RepairaComputer") shall by such request, and by acceptance of any such requested service, agree and be deemed to agree to the following policies, service terms and conditions.

  1. Payment Terms: Client agrees to pay the service charge as listed on the website based on the skill set required to complete the service for time spent by 2RepairaComputer at Client’s location. The minimum charge for In-Home Service is one hour of service. Should Client request to cancel or reschedule service this request must be received by 2RepairaComputer no later than 4 hours before the scheduled appointment time. Cancellation or changes made within 4 hours of the scheduled appointment time will be charged a one hour cancellation/change fee. 2RepairaComputer reserves the right to refuse service as well as to change fees and rates at any time without notice. If replacement parts or new software is required, such items will be the subject of a separate and additional charge as discussed with Client at the time of service. Client agrees to pay 2RepairaComputer for all charges in full at the time of service. Any amount not paid by client as specified in this Services Agreement will accrue interest at the rate of ten percent (10%) per annum. If Client wishes to dispute any charge, or make any other claim, notice of such disputed matter must be received by 2RepairaComputer, within seven (7) days of the performance of the disputed service, or the dispute of the charge, or any other claim, shall be conclusively deemed to have been waived and released.
  2. Access to and Right to Modify Hardware and Software. Client grants 2RepairaComputer, its agents and service representatives, the following access, rights, and permissions:
    • To physically disassemble any and all computer systems, components, networks, cabling, hubs, routers, switches, peripherals, and accessories.
    • To open, view, modify, edit, delete, or otherwise manipulate Client’s computer software, applications, data, and data storage media including, but not limited to, the computer Operating System, word processing, spreadsheets, databases, workflow, graphics, audio, video, system drivers and libraries, and any other type of software or data that may be contained on Client’s computer system or network.
    • To physically access Client’s home or office property where Client’s computer system and/or network resides.
    • To perform modification to Client’s home or office property for the purpose of installing or troubleshooting computer and/or networking hardware, cabling, hubs, routers, switches or peripherals. Modification may include such practices as drilling through or disassembling furniture, walls, floors, carpet or trim, laying and removing cabling and devices including affixing cabling and devices to furniture, walls, floors, or trim, using nails, screws, staples, hangers, or plastic ties.
    • To download and/or install software on Client’s computer and/or network, including but not limited to, virus scanners, diagnosis and repair utilities, drivers, libraries, and software requested to be installed by Client.
    • To install hardware in Client’s computer and/or network, including but not limited to, memory chips, processor chips, cooling fans, batteries, hard drives, tape drives, storage devices, modem and communication devices, audio and video cards, network interface cards, hubs, routers, switches, printers, scanners, cables, and any other hardware that Client requests be installed.
  3. No Warranty. WE OFFER NO EXPRESS OR IMPLIED WARRANTY OR GUARANTEE ON SERVICES PERFORMED OR PARTS PROVIDED, OTHER THAN THE MANUFACTURER’S WARRANTY. FURTHER, CLIENT ACKNOWLEDGES THAT DUE TO THE NATURE OF THE SERVICES BEING PERFORMED, THERE IS POTENTIAL RISK OF DAMAGE OR LOSS INCLUDING, BUT NOT LIMITED TO, DAMAGE TO CLIENT’S HOME, OFFICE, COMPUTER HARDWARE, CABLING, HUBS, ROUTERS, SWITCHES, PERIPHERALS, ACCESSORIES, AND FURNITURE, AS WELL AS POTENTIAL RISK OF DAMAGE, CORRUPTION, OR LOSS OF COMPUTER SOFTWARE, APPLICATIONS, DATA, AND DATA STORAGE MEDIA.
  4. Release of Liability: Client agrees to release and hold harmless 2RepairaComputer from any and all liability associated with the performance of services or the provision of parts, and from all liability for damage or loss to person or property as well as any incidental or consequential material or financial damage or loss that may result from any actions or omissions of 2RepairaComputer, its agents or service representatives.
  5. Client Responsible for Back-up of Data. 2RepairaComputer strongly recommends that Client safeguard critical data by backing up said data prior to any services performed by 2RepairaComputer. Unless specifically requested and provided as a paid service by 2RepairaComputer, Client is responsible for any backup, archiving, or protective storage as well as restoration if required, of Client’s data.
  6. Miscellaneous.
    • 2RepairaComputer is a provider of on-site services and does not offer or provide telephone technical support. Neither the signing of this agreement nor the performance of services by 2RepairaComputer implies availability of telephone technical support.
    • Client acknowledges and agrees that 2RepairaComputer may use subcontractors to perform some or all of the requested services. Client further acknowledges that any such subcontractors are precluded by their contract with 2RepairaComputer from accepting any work directly from Client, and Client agrees that it will not solicit the subcontractors to perform additional work for Client or contract for such work without the prior written consent of 2RepairaComputer.
    • This document constitutes the entire agreement between Client and 2RepairaComputer and supersedes any prior agreements or understandings, whether verbal or written, once it is accepted online by Client. No amendments, modifications, or subsequent agreemetns, whether verbal or written, shall be enforceable unless agreed to and authorized in a writing signed by both parties.
    • This Agreement shall be governed by the laws of the State of Arizona, and all disputes arising out of or under this Agreement shall have as their exclusive venue the State and Federal courts in Maricopa County, Arizona. In the even Client fails to pay 2RepairaComputer for services in accordance with the terms of this Services Agreement, Client agrees to reimburse 2RepairaComputer for all costs, including reasonable attorney's fee's, incurred in pursuing collection of Clients account. In the event of any action brought to enforce or interpret this Agreement, or arising out of this Agreement, the party prevailing therein shall be entitled to its reasonable attorneys' fees.
  7. Service Request Constitutes Agreement and Consent. By submitting a service request using the on-line form at www.2RepairaComputer.com, Client indicates that he/she has read and understands, and agrees to all of the terms and conditions of, this Consumer Agreement.
